These Terms apply to all visitors, users, and others who access or use the service.

Breevly is a URL shortening and link management platform that allows users to:

• Create shortened versions of long URLs
• Track click analytics and statistics
• Manage links through workspaces
• Use custom domains (on applicable plans)
• Monitor link performance

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account by providing accurate, complete, and current information. You are responsible for safeguarding your account credentials.

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

4. Acceptable Use

4.1 Permitted Use

You may use Breevly for lawful purposes only and in accordance with these Terms. You agree not to use the service:

• To create links to malicious, harmful, or illegal content
• To distribute spam, malware, viruses, or other harmful code

• To collect personal information about other users
• To circumvent security measures or access controls
• For phishing, fraud, or other deceptive practices
• To distribute adult content without proper age verification
• To create links that violate any applicable laws or regulations

4.3 Link Content Responsibility

You are solely responsible for the content of the original URLs you shorten. We do not monitor, endorse, or assume responsibility for the content of shortened links.

5. Service Availability and Limitations

5.1 Service Availability

We strive to maintain service availability but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or technical issues.

5.2 Usage Limits

Your use of the service is subject to the limits defined in your chosen plan:

• Number of new links per month
• Number of tracked links per month
• Number of users and workspaces
• Access to specific features

5.3 Fair Use Policy

Even within your plan limits, you must use the service reasonably. Excessive use that impacts service performance may result in temporary restrictions or account suspension.

6. Content and Data

6.1 Your Content

You retain ownership of any content you submit, post, or transmit through the service. By using our service, you grant us a limited license to use, store, and process your content solely to provide the service.

6.2 Analytics Data

We collect and process click data, analytics, and usage statistics to provide service functionality. We also use Vercel Analytics to understand service usage patterns. This data is governed by our Privacy Policy.

6.3 Data Retention

We retain your data in accordance with our Privacy Policy. Upon account termination, we will delete your data within a reasonable timeframe, except where retention is required by law.

7. Intellectual Property

7.1 Our Rights

The Breevly service, including all software, designs, text, graphics, and other content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our service.

7.2 Your Rights

You retain all rights to your original content and URLs. We claim no ownership over the websites or content you link to through our service.

7.3 Feedback

Any feedback, suggestions, or ideas you provide to us become our property and may be used without compensation or attribution.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We comply with applicable data protection laws, including the General Data Protection Regulation (GDPR).

9. Third-Party Services

Our service may integrate with or contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party services.

We use the following third-party services to provide our platform:

• Vercel (hosting and analytics)
• Supabase (database and authentication)
• Upstash (caching)
• Tinybird (analytics storage)
• Sentry (error monitoring)
• Stripe (payment processing)

10. Disclaimers and Warranties

10.1 Service Provided “As Is”

The service is provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 No Guarantee

We do not guarantee that:

• The service will be uninterrupted or error-free
• Defects will be corrected
• The service is free from viruses or harmful components
• Results obtained from the service will be accurate or reliable

11. Limitation of Liability

To the maximum extent permitted by law, Breevly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill.

Our total liability for any claims arising from or relating to the service shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Breevly from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you submit through the service

13. Modifications to Service and Terms

13.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice.

13.2 Terms Changes

We may update these Terms from time to time. We will notify you of significant changes by email or through the service. Continued use after changes constitutes acceptance of the new Terms.

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us or using account settings. Termination does not relieve you of any obligations incurred prior to termination.

14.2 Termination by Us

We may terminate or suspend your access immediately, without prior notice, if you breach these Terms or for any other reason at our sole discretion.

14.3 Effect of Termination

Upon termination:

• Your right to use the service ceases immediately
• We may delete your account and data
• Shortened links may become inactive
• These Terms remain in effect for any ongoing obligations

15. Governing Law and Jurisdiction

These Terms are governed by French law. Any disputes arising from these Terms or the service shall be subject to the exclusive jurisdiction of French courts.

For consumer users, nothing in these Terms affects statutory rights that cannot be waived or limited by contract.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Terms of Sale, constitute the entire agreement between you and Breevly regarding the service.
