These Terms of Sale govern the contractual relationship between Breevly, a sole proprietorship with registered address at 31 rue des Perdrix, 67240 Kaltenhouse, France, hereinafter referred to as “Breevly” or “we”, and any natural or legal person wishing to access the paid services offered by Breevly, hereinafter referred to as “Customer” or “you”.
Breevly provides a URL shortening and link management service accessible via the web platform breevly.com.
Use of Breevly’s paid services implies full acceptance of these Terms of Sale. These terms prevail over any other general or specific conditions not expressly agreed upon by Breevly.

Breevly reserves the right to evolve, modify, or suspend, at any time and without notice, all or part of the services for maintenance reasons or for any other reason deemed necessary.
Prices are expressed in US Dollars (USD), all taxes included. The rates in effect are those displayed on the website at the time of order.
Payment is made by credit card through our secure payment processor Stripe. The Customer guarantees that they have the necessary authorizations to use the chosen payment method.
Billing occurs automatically according to the chosen frequency.
Breevly reserves the right to modify its rates at any time. New rates will be communicated to the Customer by email at least 30 days before they take effect. In case of refusal, the Customer may cancel their subscription which will end at the expiration of the current period.
In accordance with consumer protection laws, customers may have a right of withdrawal. However, this right may not apply to digital content services that have begun execution after the customer’s express consent and acknowledgment of losing their withdrawal right.
Consumer customers have a 14-day withdrawal period from subscription if they have not yet used the service.
Subscriptions are taken out for the duration chosen by the Customer (monthly or annual) and automatically renew for the same period, unless terminated.
The Customer may cancel their subscription at any time from their customer area. Cancellation takes effect at the end of the current billing period, without prorated refund for the unused period.

In case of payment default, Breevly will send a reminder to the Customer. If not resolved within 14 days following this reminder, access to the service will be suspended until full payment of amounts due.
Late payment penalties at a rate of 3 times the legal interest rate as well as a flat fee for collection costs of €40 may be applied.
Use of the service is subject to the limits defined for each subscribed plan. In case of repeated exceeding of these limits, Breevly reserves the right to temporarily suspend access to the service or propose migration to a higher plan.
Breevly undertakes to provide the service with diligence and according to professional standards. Breevly does not guarantee that the service will be free from anomalies or errors, nor that it will function without interruption.
Breevly’s liability is limited to direct damages and cannot exceed the amount of sums paid by the Customer during the 12 months preceding the event giving rise to liability.
Breevly cannot be held responsible for indirect damages such as commercial prejudice, loss of orders, damage to brand image, loss of profits or customers.
Breevly cannot be held responsible for any delay or non-performance resulting from the occurrence of a force majeure event usually recognized by French jurisprudence.
The processing of personal data is governed by our Privacy Policy accessible on our website. Breevly undertakes to comply with the General Data Protection Regulation (GDPR).
All elements of the Breevly service (software, structure, design, etc.) are protected by intellectual property rights and remain the exclusive property of Breevly.
Breevly reserves the right to modify these Terms of Sale at any time. New conditions will be communicated by email and will take effect 30 days after this notification.
In accordance with consumer protection regulations, consumers have the right to use free mediation services for amicable dispute resolution. The contact details of the competent mediator will be provided upon request.
In case of dispute, and after failure of any attempt at amicable solution, French courts will have sole jurisdiction. French law applies.
